Reckless driving is most commonly associated with excessive speeding. Racing is also a traffic offense which will be charged as reckless driving. When a driver is going 20 or more miles per hour above the speed limit, this constitutes driving recklessly. The specific definition per Virginia law is driving “on any highway recklessly or at a speed or in a manner so as to endanger the life, limb, or property of any person…”

A simple reckless driving charge will qualify as a Class 1 Misdemeanor, which is punishable by up to 12 months in prison and/or fines of up to $2,500. Reckless driving may be charged as a felony when a driver causes the death of another.

In defending reckless driving charges in Fairfax County, it will be necessary to fully investigate and evaluate all aspects of the case. This will include everything from the initial police stop to any subsequent citation or arrest. In investigating your case, your attorney may find that the radar or lidar the officer used to determine your speed was actually improperly maintained or was not calibrated. Or, the arresting officer may have relied upon his or her “instincts” to determine how fast you were going – but this is an approximation and may not be an accurate representation of the speed at which you were traveling (an important issue in a reckless driving case, which is based upon a driver speeding 20 or more miles above the legal limit.)

Why Consult an Attorney?

An attorney can begin immediately in taking action to protect your rights and future. By talking to the police and trying to cooperate, it is more than likely that you may say or do something which will only harm your chances of avoiding a conviction and maximum penalties. A skilled traffic defense attorney will know what to do to help you avoid incriminating yourself and can help ensure that law enforcement follows procedure and does not violate your rights in any way.
